Use WeBowl to track your bowling scores and improve your game. Play fair and respect the app. While we work hard to keep everything running smoothly, we can't guarantee perfection. You're free to stop using the app anytime. If you join our partner program, stick to the guidelines to earn your commissions.
These Terms of Service ("Terms") constitute a legally binding agreement between you and WeBowl: Bowling Score Keeper ("WeBowl," "we," "us," or "our") governing your access to and use of the WeBowl mobile application (the "App") and website at webowl.com (the "Website"), collectively referred to as the "Services."
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.
YOU ACKNOWLEDGE THAT THESE TERMS CONTAIN PROVISIONS THAT LIMIT OUR LIABILITY AND REQUIRE BINDING ARBITRATION OF DISPUTES.
We reserve the right to modify these Terms at any time, in our sole discretion. We will notify you of material changes by updating the "Effective Date" at the top of this page and, where appropriate, by other means such as email or in-app notification.
Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Services immediately.
You must be at least 13 years old to use our Services. By using the Services, you represent and warrant that you meet this age requirement. If you are under 18 years old, you represent that you have obtained parental or guardian consent to use the Services.

You are solely responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.
WeBowl offers premium subscriptions (monthly, yearly, lifetime) purchased through the Apple App Store or Google Play Store. All payments, billing, cancellations, and refunds are handled by Apple or Google according to their policies.
We do not process payments or provide refunds. For any billing issues or refund requests, contact Apple or Google directly.
We may change subscription prices at any time. Changes won't affect your current subscription period.
The WeBowl Partner Program allows approved partners to earn commissions by promoting WeBowl subscriptions using unique promo codes. By applying to or participating in the Partner Program, you agree to these additional terms.
Partner applications are subject to our review and approval. We reserve the right to accept or reject any application for any reason, without explanation. Approval may be revoked at any time at our sole discretion.
Partners earn commissions on verified purchases using their promo code. Commission rates and payment terms are shown in your partner dashboard.

We can terminate your partnership anytime for any reason. If terminated, your code is deactivated and you forfeit unpaid commissions below $25. We can withhold or reclaim payments if we find fraud or rule violations.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

The Services and all content, features, and functionality (including but not limited to software, text, graphics, logos, images, and designs) are owned by WeBowl and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
"WeBowl," the WeBowl logo, and all related names, logos, product and service names, designs, and slogans are trademarks of WeBowl. You must not use such marks without our prior written permission.
All data you enter into the App (bowling scores, player information, etc.) remains your property. However, by using the Services, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your data solely for the purpose of providing and improving the Services.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WEBOWL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
You agree to defend, indemnify, and hold harmless WeBowl, its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
This indemnification obligation will survive termination of these Terms and your use of the Services.
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.
Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services and cancel any active subscriptions through Apple or Google.
All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If we can't resolve it, you agree to binding arbitration instead of going to court (except for small claims court). No class action lawsuits.
These Terms shall be governed by and construed in accordance with the laws in the United States, without regard to its conflict of law provisions.
To the extent arbitration does not apply, you agree to submit to the personal and exclusive jurisdiction of the courts located in the United States for resolution of any disputes.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WeBowl regarding the Services and supersede all prior agreements and understandings, whether written or oral.
The Services may contain links to third-party websites or services that are not owned or controlled by WeBowl. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
YOU ACKNOWLEDGE AND AGREE THAT WE SHALL NOT BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE OR LOSS CAUSED BY OR IN CONNECTION WITH USE OF ANY THIRD-PARTY CONTENT, GOODS, OR SERVICES.
If you access the App through the Apple App Store or Google Play Store, you acknowledge and agree that:
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
